Liability Waiver & Assumption of Risk — Please Read Before Signing

In consideration of being permitted to board and sail aboard the vessel JADA (the “Vessel”) operated by Sail JADA Charters LLC, I, the undersigned, acknowledge and agree to the following:

1. Assumption of Risk. I understand that sailing and boating involve inherent risks, including but not limited to: rough water, sudden weather changes, motion sickness, slippery surfaces, falling overboard, and contact with vessel equipment. I voluntarily assume all such risks.

2. Release of Liability. I hereby release and discharge Sail JADA Charters LLC, its owners, officers, crew, agents, and assigns from any and all claims, demands, damages, losses, or expenses arising from my participation in this charter, including claims arising from the negligence of released parties, except for gross negligence or willful misconduct.

3. Medical Fitness. I represent that I am in adequate physical condition to participate in this activity. I accept full responsibility for any pre-existing medical conditions.

4. Captain’s Authority. I agree to follow all instructions of the USCG-licensed captain and crew. I understand the captain has sole authority over all safety and navigational decisions and may terminate the voyage at any time for safety reasons.

5. Minors. If I am signing on behalf of a minor, I have full authority to do so and the above terms apply to the minor as well.

Governing Law: This waiver is governed by the laws of the State of California. If any provision is found unenforceable, the remainder shall remain in full force.
